This privacy policy (hereinafter: "Privacy Policy") governs the processing of your personal data as part of your visit to our website www.cc-heftrucks.be, your communication with us via email, telephone, fax and social media (hereinafter: "Social Media Channels"; e.g., Facebook, LinkedIn ...) and any order or purchase via one of our webshops.

NOTE 1: This Privacy Policy does not apply to the processing of personal data of people who choose to register via our online application platform. The processing of personal data via the application platform is governed by a separate data privacy statement, which is made available via the platform itself.

1. GENERAL

1.1. Your personal data is processed by CC Forklifts, Kwalestraat 65a, 9320 Aalst, with enterprise number 441.100.372. You can contact us via email at info@cc-heftrucks.be.

This is the entity responsible for processing your personal data as addressed in this privacy policy.

1.2. Any term starting with a capital letter is defined by explicit reference in this privacy policy. Where possible, given the context, singular words are also interpreted as plural and vice versa.

To ensure that we have the same understanding of what is written here, it is important that certain terms are interpreted the same way by you and by us.

1.3. When referring to certain laws or regulations, the reference also includes any amendment, replacement, or annulment of said law or regulation, including any related executive decisions.

Laws change from time to time, and we want to ensure that this Privacy Policy remains in accordance with such changes.

1.4. We reserve the right to modify, adjust, or enhance the Privacy Policy at our own discretion and from time to time. Such changes, modifications, or enhancements will be communicated through the website.

2. TYPES OF PERSONAL DATA WE PROCESS

We have no control over what these parties do with your personal data, therefore, we refer you to their privacy policies.

3. PROCESSING PURPOSES

3.1. We process your personal data to provide you with information, products, and services that you request in a personalized and efficient manner via the Website, email, telephone, fax, Social Media Channels, and Webshops.

We first and foremost collect and process your personal data to offer you the things you request by contacting us or by browsing our Website and Social Media Channels.

3.2. We process your personal data for marketing purposes, i.e., to provide you with targeted communications, promotions, offers, and other advertisements from us and selected partners.

Unless you are an existing customer who has already purchased similar goods or services from us and we wish to target you with our own marketing materials, we will only send you communications, promotions, offers, newsletters, and other advertisements via email or other person-to-person electronic communication channels if you have explicitly consented to receive such communications, promotions, offers, newsletters, and other advertisements.

3.3. We process your data to comply with legal obligations or to any reasonable requests from law enforcement officials or representatives, judicial authorities, government agencies or bodies, including data protection authorities.

Your data may be voluntarily disclosed to the police or judicial authorities as evidence or if there are legitimate suspicions of a criminal act or offense that you have committed by your registration at or use of the Website, Webshops, our Social Media Channels, or through any other communication with us.

We may be legally required to pass on your data to government authorities from time to time.

3.4. We may need to collect and transfer your personal data to the financial institution or payment service provider to enable your financial institution and the payment service provider to fulfill their legal obligations, such as obligations under applicable anti-money laundering and counter-terrorism financing legislation.

When we offer online payment systems to pay in our Webshops, our payment service provider or financial institution may need personal data to perform legally required checks. Therefore, we need to collect and transfer such data to the payment service provider or financial institution.

We hereby reserve the right to process your data if you use our Website, Webshops, Social Media Channels, or other communication channels in a manner that may be harmful to us or another or is unlawful.

4. LEGAL BASIS FOR PROCESSING YOUR DATA

4.1. As the responsible party for processing your data under the conditions set out in this Privacy Policy, we ask for your consent.

We are legally required to clearly state on what legal basis we process your data, taking into account the purposes we have mentioned in the previous article.

We primarily ask for your consent for the processing of your data when you fill out our contact form or place an order on our Website. When you contact us directly by phone, fax, email, or Social Media Channels, you implicitly consent to the processing of your data.

4.2. The processing of your data for the execution of an order you have placed through one of our Webshops is necessary for the performance of the contract between you and us.

When you request information or purchase something via the Webshops, data must be processed to perform the contract with you.

4.3. We must process your data for the purposes from article 3.3 and 3.4 in order to comply with our legal obligations.

Sometimes we are legally obligated to process your data.

4.4. It is necessary to process your data for the purposes from article 3.1 with a view to our legitimate interests, namely:

  • ongoing improvement of our Website, Webshops, Social Media Channels, products, and services to ensure you have the very best experience;
  • protecting our Website, Webshops, Social Media Channels, products, and services from misuse and unlawful activity;
  • marketing and promoting our products, services, and brands and the successful sale of our products and services.

We may also process your data for our own legitimate interests, which primarily relate to successfully running a business like any other company would do.

5. RECIPIENTS

5.1. We do not send your data in an identifiable manner to third parties without your explicit consent. However, you understand that your data is also processed by social media providers when you use our Social Media Channels. If you make a purchase via our Webshops, a financial institution or payment service provider may also receive your data to be able to provide its services.

We do not share your data with third parties unless you give us permission or we have anonymized your data. However, you understand that, for example, Facebook also processes your data when you use it to communicate with us. Similarly, your bank or payment service provider will process your data when you make or receive payments.

5.2. We employ external processors to offer the Website and Webshops on our behalf and to process your data. These external processors are only allowed to process your data on our behalf after we have explicitly given written instructions to do so. We guarantee that all external processors are carefully selected and are required to respect the security and integrity of your data.

Our Website and Webshops may be developed, maintained, or hosted by third parties. Similarly, we use the services of third parties such as cloud providers to process your data internally.

5.3. We may share your data with other entities within our group. However, we will ensure that all our group companies guarantee that the processing of your data complies with the content of this Privacy Policy.

6. LOCATION AND TRANSFER

6.1. We primarily process your data within the EEA. However, to process your data for the purposes from the above article 3, we may also transfer your data to other entities within our group or to third parties who process it on our behalf and are located outside the EEA. Each entity outside the EEA that processes your data must provide appropriate safeguards with respect to the processing of your data. These safeguards result from:

  • legislation in the country of receipt that can be considered equivalent to the protection provided within the EEA; or
  • a contractual arrangement between us and that entity outside the EEA. All these entities are parties to a contractual arrangement based on the EC's model contract provisions (controller to controller) (Commission Decision C(2004) 5721).

We send your data to countries outside the EEA because we share certain systems with other entities in our group or because we use a foreign service provider. However, we ensure that your data is secure when we send it to countries outside the EEA.

6.2. We have the right to pass on anonymized and/or aggregated data to organizations outside the EEA. In the event of such a transfer, we ensure safeguards that guarantee the security and integrity of your data, as well as all rights regarding data that you may enjoy under applicable mandatory law.

We can anonymize your data or combine it with data from others and thus make it impossible to identify you. Such anonymous or aggregated data can also be passed on to countries outside the EEA.

 

7. QUALITY GUARANTEES

7.1. We do our utmost to process only data that is necessary to achieve the purposes mentioned in article 3.

We do not process more data about you than we need for the purposes we have communicated to you.

7.2. Your data is processed only as long as necessary for the purposes mentioned in article 3 of this Privacy Policy or until you withdraw your consent for processing. Withdrawing your consent may imply that you can no longer use the Website, Webshops, Social Media Channels, and other communication channels fully or partially. We will de-identify your data when it is no longer necessary for the purposes from article 3, unless there is:

  • a compelling interest of ours, your financial institution, the payment service provider, or another third party in keeping your data identifiable;
  • an obligation from the law or regulations or a judicial or administrative order that prevents us from de-identifying it.

7.3. An essential aspect of our marketing efforts is making our marketing materials more relevant to you. 8. YOUR RIGHTS

8.5. You have the right to object to the processing of data if you can prove that there are serious and justified reasons connected with your particular circumstances that justify this objection. If the intended processing can be described as direct marketing, you have the right to object to such processing free of charge and without justification.

8.7. Send an email to privacy@cc-heftrucks.be if you wish to make a request to exercise one or more of the above rights. An email with the request to exercise a right should not be construed as consent for the processing of your data, other than the processing necessary to handle your request. Such a request should clearly state which right you wish to exercise and if necessary for what reasons. The request should also be dated and signed and accompanied by a digitally scanned copy of your valid identity document. If you use the contact form, we may ask you for a signed confirmation and an identity document.

We will notify you promptly of the receipt of this request. If the request proves to be valid, we will implement it as soon as possible and at the latest thirty (30) days after receipt of the request.

8.1. You have the right to request access to all data that we process about you. We reserve the right to charge administrative costs for multiple consecutive requests for access that are clearly submitted to hinder or harm us.

8.2. You have the right to request that data about you that is incorrect be corrected free of charge. If a correction request is submitted, it must be accompanied by proof of the inaccuracy of the relevant data.

8.3. You have the right to withdraw your previously given consent for the processing of your data, in which case article 8.4 applies.

8.4. You have the right to request that data about you be erased if it is no longer necessary with respect to the purposes set out in article 3 or if you withdraw your consent for its processing. However, you should keep in mind that we weigh a request for erasure against:

  • compelling interests of ours, your financial institution, the payment service provider, or another third party;
  • obligations from the law or regulations or judicial or administrative orders that are contrary to this erasure.

Instead of erasure, you may also request a restriction of the processing of your data if and when (a) you contest the accuracy of the data, (b) the processing is unlawful, or (c) the data is no longer needed for the purposes mentioned in article 3 but you need it to defend yourself in legal proceedings.
